In a brief yet significant order, the Meghalaya High Court on Thursday (October 16, 2025) allowed an application by petitioner Inamul Hoque, seeking to include Smti. Nasrina Abdin as a necessary party in an ongoing case involving the state’s Health Department. The decision came from Justice H.S. Thangkhiew, who presided over the matter in Shillong.

The hearing, held under a relatively quiet courtroom setting, lasted only a few minutes but ensured procedural fairness before the next phase of the main writ petition.

Background

The case MC [WP(C)] No. 273 of 2025 in WP(C) No. 446 of 2024 revolves around a writ petition filed by Shri Inamul Hoque, son of Late Mazaffar Hussain, against the State of Meghalaya, represented by the Commissioner and Secretary of the Health Department, and the Director of Health Services (MI).

While the main petition remains pending, Hoque moved a miscellaneous application to implead (add) Nasrina Abdin, a resident of Kukurmua, Mahendraganj, South West Garo Hills District, claiming her presence was crucial for a fair adjudication of issues.

Court’s Observations

During the short hearing, Ms. M. Rahman, counsel for the petitioner, submitted that the impleadment of Smti. Abdin was necessary to “ensure that the matter is heard in totality and no affected party is left out.”

Interestingly, the state government, represented by Mr. A.H. Kharwanlang, Additional Senior Government Advocate, did not raise any objection to the request. Supporting counsels Ms. S. Laloo and others also refrained from contesting the motion.

“The bench observed, ‘Since there is no objection from the respondents, the application for impleadment is allowed,’” the order read. The judge also took note that the impleadment was procedural and did not alter the substance of the main writ.

Decision

Allowing the application, Justice Thangkhiew ordered that Smti. Nasrina Abdin be impleaded as Respondent No. 3 in the writ petition. He further directed the Registry to make the necessary corrections in the case title and officially record the addition.

With this, the court closed and disposed of the miscellaneous application, clearing the way for the main case to proceed with all relevant parties on record.

As the gavel fell, the courtroom settled back into silence - a small procedural order, but one that ensures no voice is left unheard in the ongoing dispute involving Meghalaya’s Health Department.
