The Madras High Court on Friday issued notice in a set of appeals filed by G.B. Pachaiyappan and the Thondai Mandala Saandror Dharma Paribalana Sabai, challenging an earlier injunction order involving actor-turned-politician Vijay's political outfit, Tamilaga Vettri Kazhagam. The bench clarified that admission of the appeals would not stop the single judge from continuing with the ongoing trial of the suit.
Background
The dispute traces back to an order passed by a single judge of the Madras High Court on August 18, 2025. That order had been delivered in a series of interim applications OA Nos. 713 to 715 linked to a commercial division suit (CS No. 178 of 2025). Pachaiyappan, representing himself and the Dharma Paribalana Sabai, had opposed the order and approached the appellate bench.
Their contention essentially revolves around alleged infringement of rights and the functioning of Vijay’s newly launched political party. They sought to set aside the single judge’s ruling, calling it detrimental to their interests.
Court's Observations
When the appeals O.S.A (CAD) Nos. 102, 103, and 104 of 2025 came up for hearing before the division bench comprising Justice G. Jayachandran and Justice Mummineni Sudheer Kumar, the court decided to admit the matter and call for responses.
“The respondents are to be served notice, returnable in six weeks,” the bench directed.
Private notice was also permitted, meaning the appellants themselves may serve the respondents directly in addition to the court’s process.
At the same time, the judges made an important clarification to prevent any procedural confusion.
"We make it clear that the admission of the appeal will not stand in the way of the single judge to proceed with the trial of the suit," the order noted.
This effectively ensures that while the appellate proceedings are pending, the original case in the commercial division will continue without interruption.
Decision
In its brief order, the division bench thus struck a balance: allowing the appeals to be heard while safeguarding the progress of the trial. The matter has now been posted for further hearing after six weeks, giving time for the respondents including Vijay and his political organisation Tamilaga Vettri Kazhagam to file their replies.
For now, the stage is set for a more detailed legal battle in the coming months, with the High Court signalling that both the appellate and trial tracks will run side by side.
