The Rajasthan High Court at Jaipur on Tuesday permitted petitioner Suman Yadav, wife of Gajendra Singh Yadav, to withdraw her criminal writ petition with the liberty to pursue an alternative legal remedy. The matter came up before Justice Mahendar Kumar Goyal, who heard brief submissions from both sides before recording the withdrawal.

The case S.B. Criminal Writ Petition No. 994/2025 was filed by Suman Yadav against the State of Rajasthan and several private respondents residing in the Teja Vihar area of Jaipur. The petitioner, represented by advocate Gajendra Bhawan for Mr. Lucky Sharma, had sought judicial intervention over a police-related grievance involving her neighborhood and alleged inaction by authorities.

During the brief hearing, the petitioner's counsel informed the bench that they wished to withdraw the writ petition in light of an earlier coordinate bench decision, which offered an alternate remedy for similar circumstances. The earlier reference case was Suman Meena and Another vs State of Rajasthan & Others (S.B. Criminal Writ Petition No. 792/2024) decided on 2 August 2024.

Justice Goyal noted that since the petitioner herself expressed willingness to withdraw and opt for the alternative remedy available, there was no reason to continue the proceedings.

The bench observed, "The petitioner is at liberty to avail the remedy as provided by the coordinate bench in the earlier order dated 02.08.2024," the order recorded.

The judge's brief but clear remark reflected a judicial preference for consistency, where similar issues should be dealt with through established procedural channels rather than duplicating writ petitions.

The Court, therefore, dismissed the writ petition as withdrawn, granting liberty to the petitioner to seek relief through the appropriate alternative legal route as suggested by the previous ruling. All pending applications connected with the case were also disposed of.

With that, the bench concluded the short proceeding in less than ten minutes, a common practice in matters where the petitioner chooses voluntary withdrawal.
