Vincent & Ors. against the Joint Registrar of Cooperative Societies & Ors. The petitioners were permitted to withdraw the petition and pursue statutory remedies available under the law.

Background of the Case

The petition arose from an impugned judgment and order dated March 4, 2025, passed by the High Court of Kerala at Ernakulam in WA No. 1620/2024. The petitioners sought special leave to appeal against this order.

The matter was heard by a bench comprising Hon’ble Mr. Justice Vikram Nath and Hon’ble Mr. Justice Sandeep Mehta. The petitioners were represented by Senior Advocate Dama Seshadri Naidu, along with Advocates Ashish Jacob Mathew, Sabari C.P., and AOR Manu Krishnan G.

During the hearing, Senior Advocate Dama Seshadri Naidu requested permission to withdraw the petition, stating that the petitioners wished to pursue statutory remedies available under the law.

"Mr. Dama Seshadri Naidu, learned senior counsel appearing for the petitioners, states that he may be permitted to withdraw the present petition leaving it open for the petitioners to avail the statutory remedy as may be available under the law, which should be considered on its own merits without being influenced by any of the observations made in the impugned order."

Accepting this request, the Supreme Court dismissed the SLP as withdrawn, granting the petitioners the liberty to pursue alternative legal remedies.

The court’s order ensures that the petitioners can approach the appropriate statutory authorities without being prejudiced by any observations made in the impugned High Court order. This upholds the principle that each legal remedy should be considered independently on its merits.
