What is ISA
The Indian Stamp Act, 1899 (Act 2 of 1899) is a fiscal statute enacted to consolidate and amend the law relating to stamps in India. It received assent on 27th January 1899 and came into force on 1st July 1899. The Act replaced earlier, fragmented regulations on stamp duty, providing a uniform framework for levying duties on a vast array of legal instruments.
Its primary objectives are to generate revenue for state governments and to prevent fraud by ensuring that certain classes of instruments are properly stamped and, thereby, made admissible in evidence. The Act is administered by state governments, which have the power to prescribe stamp duty rates through Schedule I, and is a companion law to the Registration Act, 1908, as proper stamping is a prerequisite for registering instruments like sale deeds and conveyances.
