Section 49: Penalty on officers making vexatious search, seizure, detention or arrest

Penalty on officers making vexatious search, seizure, detention or arrest.

- Any Excise Officer or Officer of the Police, Land Revenue Department or any other person duly empowered under Section 52, who vexatiously and unnecessarily -

(a)

enters or searches or causes to be entered or searched any place under colour of exercising any power conferred by this Act, or

(b)

seizes the movable property of any person on the pretence of seizing or searching for any article liable to confiscation under this Act, or

(c)

detains, searches or arrests any person, shall be punishable with imprisonment for a term which may extend to three months, or with fine which may extend to five hundred rupees, or with both.
