Article 375: Courts, authorities and officers to continue to function subject to the provisions of the Constitution

Part III: Fundamental Rights

All courts of civil, criminal and revenue jurisdiction, all authorities and all officers, judicial, executive and ministerial, throughout the territory of India, shall continue to exercise their respective functions subject to the provisions of this Constitution.

VERSION 1

Article 309, Draft Constitution of India 1948

All courts of civil, criminal and revenue jurisdiction, all authorities and all officers, judicial, executive and ministerial, throughout the territory of India shall continue to exercise their respective functions subject to the provisions of this Constitution.

VERSION 2

Article 375, Constitution of India 1950

All courts of civil, criminal and revenue jurisdiction, all authorities and all officers, judicial, executive and ministerial, throughout the territory of India, shall continue to exercise their respective functions subject to the provisions of this Constitution.

SUMMARY

Draft Article 309 was discussed in the Constituent Assembly on7 October 1949. It was part of the Draft Constitution’s transitional provision. It declared that all courts, authorities and officers within India would continue to perform their respective functions but bound by the Constitution.   

There were no amendments made to the Draft Article and it was adopted as a part of the Constitution on the same day.
