Vexatious search, etc., by officers of Enforcement .-(1) Any officer of Enforcement exercising powers under this Act or any rule made thereunder who,-
(a)without reasonable ground of suspicion, searches or causes to be searched any place, premises, aircraft, vehicle or vessel; or(b)vexatiously detains or searches or arrests any person, shall, for every such offence, upon conviction by a Court, [be punishable with imprisonment for a term which may extend to two years or with fine which may extend to ten thousand rupees or with both].(2)
Any person wilfully and maliciously giving false information and so causing an arrest or a search to be made under this Act shall, upon conviction by a Court, be punishable with imprisonment for a term which may extend to two years or with fine which may extend to [ten thousand rupees] [ Substituted by Act 29 of 1993, Section 29, for " two thousand" (w.e.f. 8.1.1993).] or with both.Previous
Sec 57 — Penalty for contravention of order made by adjudicating officer, Appellate Board and High Court .-If any person fails to pay the penalty imposed by the adjudicating officer or the Appellate Board or the High Court or fails to comply with any of his or its directions or orders, he shall, upon conviction by a Court, be punishable with imprisonment for a term which may extend to two years or with fine or with both

Sec 59 — Presumption of culpable mental state .-(1) In any prosecution for any offence under this Act which requires a culpable mental state on the part of the accused, the Court shall presume the existence of such mental state but it shall be a defence for the accused to prove the fact that he had no such mental state with respect to the act charged as an offence in that prosecution
