Section 58: Vexatious search, etc., by officers of Enforcement .-(1) Any officer of Enforcement exercising powers under this Act or any rule made thereunder who,

Vexatious search, etc., by officers of Enforcement .-(1) Any officer of Enforcement exercising powers under this Act or any rule made thereunder who,-

(a)without reasonable ground of suspicion, searches or causes to be searched any place, premises, aircraft, vehicle or vessel; or(b)vexatiously detains or searches or arrests any person, shall, for every such offence, upon conviction by a Court, [be punishable with imprisonment for a term which may extend to two years or with fine which may extend to ten thousand rupees or with both].

Any person wilfully and maliciously giving false information and so causing an arrest or a search to be made under this Act shall, upon conviction by a Court, be punishable with imprisonment for a term which may extend to two years or with fine which may extend to [ten thousand rupees] [ Substituted by Act 29 of 1993, Section 29, for " two thousand" (w.e.f. 8.1.1993).] or with both.
