The Jammu and Kashmir State Ranbir Penal Code, 1989

[ Sexual harassment and punishment therefor. [Inserted by Jammu and Kashmir Act No. 11 of 2014, dated 22.3.2014.]

(1)

A man committing any of the following acts, -

(i)

physical contact and advances involving unwelcome and explicit sexual overtures; or

(ii)

a demand or request for sexual favours; or

(iii)

forcibly showing pornography; or

(iv)

making sexually coloured remarks; shall be guilty of offence of sexual harassment.

(2)

Any person who commits the offence specified in clause (i) or clause (ii) or clause (iii) of sub-section (1) shall be punished with rigorous imprisonment which may extend to three years and with fine.

(3)

Any person who commits the offence specified in clause (iv) of subsection (1) shall be punishable with imprisonment of either description which may extend to one year and with fine.
