Section 77: Roadside trees

Roadside trees.

- All road-side trees on lands held by any person which have been planted and reared by or under the orders of and at the expense of the State Government and all trees which have been planted and reared at the expense of any local authority by the side of any road, belonging to the State Government, vest in the State Government; but in the event of such trees dying, or being blown down, or being cut down by order of the [Tahsildar] [Substituted by Act 5 of 1970 w.e.f. 23.10.1969.], the timber shall become the property of the holder of the land in which they were growing; and the usufruct including the loppings of such trees shall also vest in the said holder:Provided that the trees shall not be lopped except under the orders of the [Tahsildar] [Substituted by Act 5 of 1970 w.e.f. 23.10.1969.].
