Section 57: Unauthorized occupation of highway

Unauthorized occupation of highway.

- Whoever-

(a)

occupies or makes any encroachment on any highway in contravention of the provisions of sub-section (1) of section 21, or

(b)

fails to comply with the notice served on him under sub-section (1) of section 23 for no valid reason,

shall, on conviction, be punished-

(a)for a first offence with fine which may extend to [one thousand rupees] [These words were substtuted for the words 'two hundred and fifty rupees' by Maharashtra 37 of 1999, Section 12(a).],

(b)for a subsequent offence in relation to the same encroachment with fine which may extend to [two thousand rupees] [These words were substituted for the words 'five hundred rupees' by Maharashtra 37 of 1999, Section 12sb).] plus a further fine not exceeding [hundred rupees per day] [These words were substituted for the words 'fifty rupees per day' by Maharashtra 37 of 1999, Section 12(c).] on which such occupation of the highway or encroachment continues.
