Section 112: Restriction on buildings in slum improvement area

Restriction on buildings in slum improvement area.

(1)

A Board may by a notice affixed or exhibited in a conspicuous place in a slum improvement area direct that no person shall erect any building in a slum improvement area or carry out any additions or alterations thereto except with its previous permission in writing.

(2)

Every person desiring to obtain permission referred to in sub-section (1) shall make an application in writing to the Board furnishing such information as may be required by it.

(a)

On receipt of such application and after making such inquiry as it considers necessary, the Board may by order in writing -

(b)

either grant the permission subject to such terms and conditions, if any, as may be specified in the order, or

refused to grant such permissionProvided that, before granting the permission subject to terms and conditions or before making an order refusing such permission, the applicant shall be given a reasonable opportunity to show cause why such terms and conditions should not be imposed, or the permission should not be refused.
