Section 22P: State Police Complaints Authority
State Police Complaints Authority.
(1)
The State Government shall, by notification in the Official Gazette, constitute for the purposes of this Act, an Authority to be called the State Police Complaints Authority.(2)
The State Police Complaints Authority shall consist of the following members, namely:--(a)
A retired High Court Judge ...Chairperson;(b)
A Police Officer superannuated in the rank not below the rank of Special Inspector General of Police ...Member;(c)
A person of eminence from the civil society ...Member;(d)
A retired officer not below the rank of Secretary to the State Government ...Member;(e)
Officer not below the rank of Additional Director General and Inspector General of Police ...Member-Secretary.(3)
On the constitution of the State Police Complaints Authority under this Act, the erstwhile State Police Complaints Authority constituted by the Home Department under the Government Resolution, dated the 15th July 2013 shall cease to exist:Provided that, the complaints and inquiries pending before the erstwhile State Police Complaints Authority shall continue to operate as if such complaints or inquiries are pending with the State Police Complaints Authority constituted under this Act and the recommendations made by the erstwhile State Police Complaints Authority shall continue to operate as if the same are made by the State Police Complaints Authority constituted under this Act.(4)
The Chairperson of the State Police Complaints Authority shall be chosen by the State Government out of a panel of names proposed by the Chief Justice of the High Court.Previous
