The Delhi High Court has granted 30 days of custody bail to Farhan Ansar Suse to undergo surgery and medical treatment at a private hospital of his choice in Delhi/NCR. The Court, however, declined to permit him to travel to Bombay for treatment, in view of the alleged network in Padgha and the neighbouring areas of Maharashtra.
A Division Bench comprising Justice Prathiba M. Singh and Justice Vikas Mahajan was hearing an appeal under Section 21(4) of the National Investigation Agency Act, 2008. The appeal challenged the August 1, 2026 order of the Special Court, NIA, which rejected Suse’s application for interim bail on medical grounds.
According to the NIA, Suse was charge-sheeted in FIR RC-29/2023/NIA/DLI, registered under Sections 120B and 387 of the IPC and Sections 13, 18, 18A, 20, 38 and 39 of the UAPA. The chargesheet was filed on March 21, 2024, followed by a supplementary chargesheet on June 3, 2024. The trial had reached the stage of arguments on charge.
The prosecution allegations, as recorded in the supplementary chargesheet, included an alleged connection with ISIS, alleged collection of money from businessmen and circulation of messages on behalf of ISIS. The order also records allegations that Suse collected large sums of money in cash and opened bank accounts in different names, including an account in the name of another co-accused, which he was allegedly operating.
Suse is stated to be suffering from umbilical hernia, bronchial asthma and Type-II diabetes. He had been examined at Deen Dayal Upadhyay Hospital, where surgery was suggested. The Trial Court had earlier rejected interim bail after noting that he was receiving treatment and that doctors were waiting for his health to stabilise.
The High Court focused only on the medical issue while deciding the present appeal.
The Court observed:
"The reasons for the same need not be gone into by this Court, as the Appellant, being medically unwell, cannot be prevented from undergoing treatment at a private hospital at his own expense."
The Bench permitted Suse to undergo treatment at a private hospital of his choice in Delhi/NCR while remaining in custody. His hospital expenses will have to be borne by him. The custody bail will operate for 30 days from the date of admission.
The Court also directed that he may be accompanied by up to two immediate family members during hospitalisation, but prohibited communication with other relatives, acquaintances or persons named in the charge-sheet. After the custody bail period expires, he must be shifted back to jail.
The appeal was accordingly disposed of.
