The Orissa High Court has dismissed a habeas corpus petition filed by a husband seeking the production of his wife, observing that such petitions cannot be misused to settle personal disputes or pressure a spouse into returning to the matrimonial home. The court also imposed a cost of ₹50,000 on the petitioner.

Background of the Case

The petitioner claimed that his wife had been kidnapped and sought the court's intervention through a writ of habeas corpus. However, the court examined the petitioner's own documents, which revealed that he had personally met his wife and requested her to return home. She declined and chose to live separately because of matrimonial differences.

The Division Bench noted that there has been a growing trend of filing habeas corpus petitions to exert pressure in matrimonial disputes rather than to address genuine cases of illegal detention.

The bench observed,

'The wife is a major and capable of taking decision of her life and cannot be treated as a chattel in the hands of her husband.'

The judges further held that a woman who voluntarily leaves her matrimonial home cannot be treated as a kidnapping victim merely because she refuses to return. The court found that the petitioner had created an illusory cause of action and had not approached the court with clean hands.

The High Court dismissed the writ petition and directed the petitioner to deposit ₹50,000 with the State Legal Services Authority within two weeks.

The court ordered that the amount be earmarked for the welfare of juveniles.
