The Allahabad High Court, Lucknow Bench, has disposed of a Public Interest Litigation (PIL) that sought directions to restrain Uttar Pradesh Police from allegedly removing posters of certain Iranian religious leaders and taking coercive action against people participating in religious mourning. The Court held that the petition lacked specific facts to justify interference.
The petitioner sought directions preventing police authorities from interfering with the peaceful display of portraits of religious leaders on private properties and requested a decision on representations submitted to the State Government. However, the petition did not identify any particular incident, location, or officer allegedly involved.
A Division Bench of Justice Rajan Roy and Justice Manjive Shukla observed that the allegations were based on broad and general assertions without supporting particulars.
The bench observed,
“On such vague and general averments a Public Interest Litigation cannot be maintained nor proceeded with.”
It further noted that if any individual has a specific grievance against police action, the appropriate legal remedy under the law remains available.
Finding no concrete material to examine the wide-ranging reliefs sought, the High Court disposed of the PIL without granting the requested directions.
