The Madhya Pradesh High Court has declined to order the closure of a private school in Umaria district despite finding serious shortcomings in its infrastructure and facilities. Instead, the Court stressed that the priority should be protecting children's education while ensuring the deficiencies are removed through coordinated efforts by local authorities and the Gram Panchayat.
Background of the Case
The Public Interest Litigation (PIL) was filed by Manggi Bai Kole and others, who are the Sarpanch and Up-Sarpanch of Gram Panchayat Kotari. They sought cancellation of the recognition granted to Devarsi High School, alleging that the institution lacked basic amenities such as safe classrooms, toilets, drinking water, electricity, playground facilities, and adequate teaching staff.
They also relied on an inquiry report prepared by the Block Education Officer, which highlighted multiple deficiencies and described the school building as unsafe.
Court Observation
A Bench of Acting Chief Justice Vivek Rusia and Justice Pradeep Mittal noted that the inspection reports pointed to several shortcomings requiring immediate attention. However, the Court also observed that the school is the only educational institution in the Gram Panchayat and that there is no government school available in the village.
The Bench observed,
"Closing down the institution would directly jeopardise the academic future of the local children."
It further said that
"constructive and coordinated efforts must be made by all stakeholders to systematically eliminate the highlighted deficiencies in the public interest."
The Court also remarked that PILs should encourage practical solutions and that even petitioners claiming to work for public welfare can be directed to participate in resolving public issues.
Court's Decision
The High Court directed the Gram Panchayat to place the issue before its General Body Meeting and pass a resolution outlining measures to remove the deficiencies with the cooperation of local villagers.
It further asked the petitioners to submit a compliance report supported by affidavits. Copies of the order were directed to be sent to the Collector, District Education Officer, and the CEO of the Janpad Panchayat, Umaria, for necessary action.
With these directions, the PIL was disposed of.
