Delhi HC Puts Criminal Complaint Against Six CBI Officers on Hold Over Alleged False Court Statement

The Delhi High Court has kept in abeyance its earlier direction to initiate criminal complaint proceedings against six former and serving Central Bureau of Investigation (CBI) officers over an allegedly false statement made before a court. The interim order will remain in force until the next hearing.

Background

The matter arose from a plea filed by former Indian Revenue Service (IRS) officer Ashok Kumar Aggarwal. On October 6, 2026, Justice Madhu Jain had directed the Special Judge (CBI) to file a written complaint against six officers over statements concerning correspondence with the government about challenging Aggarwal's discharge.

Two former CBI officers, Sushil Dewan and Raman Tyagi, subsequently sought recall of that judgment, arguing that they had not been properly heard before the directions were issued. The CBI also supported their applications.

Justice Mini Pushkarna considered the objections raised by the applicants and observed:

"The applicants have established a prima facie case."

The Court further noted that the balance of convenience favoured the applicants and that they could suffer irreparable injury if interim protection was not granted.

The Court further recorded:

"The matter requires consideration."

It also observed that Section 341 of the Code of Criminal Procedure requires the Court to decide an appeal after issuing notice to the concerned parties.

Justice Mini Pushkarna directed that the relevant directions in paragraphs 63 and 64 of the October 6 judgment shall remain in abeyance until the next hearing.

The matter has been listed for February 4, 2027.
