The Delhi High Court will hear on Friday, October 9, 2026, a petition filed by the Indian Youth Congress (IYC) challenging the Delhi Police’s refusal to permit a proposed demonstration at Jantar Mantar against Chief Election Commissioner Gyanesh Kumar. The plea was mentioned on Thursday, October 8, before a Division Bench comprising Acting Chief Justice Nitin Wasudeo Sambre and Justice Sanjay Sharma.

The petition was filed by IYC National President Uday Bhanu Chib through Advocate Roopesh Singh Bhadauria. The petitioner states that permission was sought on September 25 for a peaceful demonstration involving around 100 to 150 people. According to the plea, the organisers undertook to comply with conditions relating to security, traffic and public order.

The petitioner challenged the police order dated October 1, 2026, stating that the refusal was communicated on the proposed first day of the demonstration.

Senior Advocate Sanjoy Ghose mentioned the matter before the Bench and sought an early hearing. The Court said the matter would be listed on Friday and that, if it was not listed, the petitioner could mention it again for urgent hearing.

The petition argues that the power to regulate a peaceful assembly cannot be used to prohibit it without an individualised and proportionate assessment. It invokes Articles 14, 19(1)(a) and 19(1)(b) of the Constitution and challenges the alleged mechanical application of guidelines governing protests.

The Delhi High Court has therefore listed the matter for hearing on October 9, 2026. No opinion on the merits of the petition or on the legality of the Delhi Police’s refusal has been expressed at this stage.
