The Delhi High Court has granted regular bail to a husband accused of attacking his wife inside the court premises during a hearing arising out of their matrimonial disputes. The bail was granted after the complainant, who is the applicant’s wife, told the Court that she had withdrawn the matrimonial proceedings and did not wish to pursue the present criminal case against her husband.
Justice Mini Pushkarna passed the order on September 23, 2026. The Court also noted that the applicant had been arrested on the date of the incident and that, as submitted before the Court, there was no previous incident involving him.
Background
The FIR, registered as FIR No. 91/2025 on January 28, 2025, concerns an incident arising during matrimonial disputes between the applicant and his wife. According to the submissions recorded in the order, an altercation occurred during a court hearing, following which the applicant allegedly attacked his wife inside the court premises. He was arrested on the same day.
The Court was informed that there was no previous incident involving the applicant. It was also submitted that the complainant had withdrawn her divorce and guardianship proceedings against him.
The complainant, identified before the Court by the Investigating Officer, personally appeared and interacted with the Bench. She stated that she did not wish to pursue the present case against her husband and wanted to resume their matrimonial life peacefully. She also informed the Court that they have an 11-year-old son.
The State's Additional Public Prosecutor stated that, in view of the complainant's position, there was no objection to the bail application being allowed.
Considering the overall facts and circumstances, Justice Mini Pushkarna held that the case was fit for grant of bail.
"Accordingly, considering the overall conspectus of the facts and circumstances of the present case, this Court considers the present to be a fit case for grant of bail."
The Court directed Vijay Kumar's release on regular bail on furnishing a personal bond of Rs. 25,000 with one surety of the same amount. He was also directed to appear before the Trial Court on every hearing date, keep his residential and mobile details updated, report to the jurisdictional police station every Monday at 9:00 AM, and not influence witnesses or tamper with evidence.
The bail application was accordingly allowed and disposed of. The Court clarified that its observations were limited to deciding the bail application and would not affect the trial on merits.
