The Supreme Court on September 28 set aside the Bombay High Court’s order granting bail to Shiv Sena corporator Ramesh Sukrya Mhatre in a case arising from the alleged assault of doctors and hospital staff at Shastrinagar Hospital in Kalyan-Dombivli, Maharashtra. The order was passed by a bench of Justice Vikram Nath and Justice Sandeep Mehta.
The case relates to an incident reported on July 6, 2026, at the municipal hospital. Mhatre was arrested in connection with allegations concerning an altercation with doctors and hospital staff. A Magistrate initially granted him bail on July 14.
The Bombay High Court later took suo motu cognisance - meaning it initiated proceedings on its own - and stayed the bail order during a special sitting on July 18. On August 7, the High Court subsequently granted Mhatre bail subject to stringent conditions, including restrictions on his stay and movement.
The State of Maharashtra challenged the grant of bail before the Supreme Court. On September 7, the Court had issued notice on the State’s challenge after Mhatre withdrew his separate plea against the stringent bail conditions.
During the hearing, Mhatre’s counsel argued that he had already spent time in custody, had cooperated with the proceedings and that the case was triable by a Magistrate. The State opposed the continuation of bail.
The Supreme Court also referred to the allegations concerning attacks on medical professionals and another reported incident involving doctors in Maharashtra. Justice Sandeep Mehta observed:
“The message must go loud and clear. Medical fraternity cannot be touched and attacked in this manner.”
The Court also considered whether Mhatre’s release could affect the ongoing trial.
The Supreme Court allowed the State’s appeal and set aside the Bombay High Court’s August 7 order granting bail to Ramesh Sukrya Mhatre.
The Court directed him to surrender within three days.
