The Kerala High Court has sought the State government’s response to a petition challenging the suspension of an Upper Primary School teacher over a quiz question identifying V.D. Savarkar as the freedom fighter who received the maximum punishment from the British.
Justice Viju Abraham considered the matter on August 13, 2026, and asked the Government Pleader to obtain instructions on the reasons behind the teacher’s suspension. The Court posted the matter for August 17.
Background of the Case
The petition was filed by Guruprasad Rai K, who was associated with the preparation of a question paper for the “Social Science Club Freedom Quiz 2026” at an aided school in Kasaragod.
The disputed question asked:
“Who was the Freedom Fighter who received the maximum punishment from the Britishers?” The answer provided in the key was V.D. Savarkar.
Following controversy over the question, the teacher was placed under suspension by the Deputy Director of Education, Kasaragod, under Section 12A of the Kerala Education Act, 1958.
The teacher has challenged the suspension, arguing that the action was taken following directions from the Education Minister and that the order did not properly explain why suspension was necessary.
Court’s Observation
During the hearing, Justice Viju Abraham questioned whether suspension was justified in the circumstances.
The Court observed,
“You can go on with the disciplinary proceedings, but how can you suspend someone for this? Can suspension be a form of punishment?”
The Bench also directed the Government Pleader to specifically explain the reasons for which the petitioner was suspended.
Petitioner’s Contentions
The petitioner argued that disciplinary proceedings could continue without resorting to suspension. He also relied on historical records concerning Savarkar’s incarceration and referred to a commemorative stamp issued by the Government of India in 1970.
The plea further contended that the suspension was based on the controversy surrounding the answer rather than any established misconduct.
Decision
The Kerala High Court did not decide the merits of the suspension at this stage. It sought the State’s response and directed the Government Pleader to apprise the Court of the specific reasons for the suspension.
The matter was adjourned to August 17, 2026.
