Patna High Court Modifies Status Quo Order for Bihar Sanskritik Vidyapeeth

The Patna High Court, in a recent judgment dated 13-08-2025, modified its earlier order directing status quo in the functioning of Bihar Sanskritik Vidyapeeth. The case (CR. Misc. No.2699 of 2025) arose from a dispute involving the institution's management, with Mahant Kamal Narayan Das, the elected Secretary, seeking modification of the order dated 16.04.2024.

Background of the Case

The petitioner argued that the status quo order hindered the daily operations of the Vidyapeeth, including maintenance work, rituals, and educational activities. The Executive Committee, elected by the Aam Sabha and registered under the Society Registration Act, had been approved by the Inspector General of Registration, Bihar. Despite this, the order created obstacles in managing the institution.

Justice Rajesh Kumar Verma noted that the Registration Department had recognized the petitioner as the elected Secretary and the Executive Committee as valid. The court observed that the status quo order had become a hurdle in the institution's functioning. Consequently, the directive to "maintain status quo" was expunged from the earlier order.

"The order dated 16.04.2024 is modified to the extent that the sentence 'both the parties are directed to maintain status-quo' shall be expunged."

The Opposite Party No. 2 contended that modification was unnecessary as title suits (No. 6 of 2020 and No. 303 of 2021) were still pending. However, the court prioritized the institution's operational needs, ensuring smooth management while legal disputes continued.
