The Punjab and Haryana High Court has restrained judicial officers posted in the Sessions Division, Rohtak, from entertaining bail applications arising from a case involving allegations of large-scale cheating of real estate investors.
Justice N.S. Shekhawat passed the order while hearing an anticipatory bail petition filed by Subhash Gupta in connection with FIR No. 127 dated May 27, 2026, registered at Police Station I.M.T., Rohtak.
Background
The High Court noted that during an earlier hearing on August 5, it had raised serious concerns about the manner in which the investigation was being conducted. The Court observed that attempts appeared to have been made to shield persons allegedly responsible for cheating several investors of crores of rupees.
The Court also referred to a broader pattern in which real estate developers collect substantial sums from buyers after promising timely accommodation, but purchasers are subsequently left without possession or return of their investment.
"Even such systematic frauds are projected as isolated disputes arising out of contractual relationship, but when the Courts examine such disputes, it is found that such disputes form part of larger conspiracy to cheat the innocent buyers of their earning of whole life," the Court observed.
The Bench noted that the investigation was being conducted by a Special Investigation Team headed by Rohtak Superintendent of Police Gaurav Rajpurohit. It was informed that Kuldeep Kumar Tahlan, a director of M/s DHL Infratech Private Limited, and Gurvinder Jeet Singh, an employee of M/s Gupta Property Developers, Shivji, had been arrested.
The Court took note of differing bail outcomes involving various accused. It recorded that Kuldeep Kumar Tahlan had been granted bail, while Gurvinder Jeet Singh's bail plea had been dismissed. Four other co-accused connected with DHL Infratech had received interim anticipatory bail from the same presiding officer who had dismissed the petitioner's bail application.
The Bench further recorded that Subhash Gupta's arrest had earlier been stayed on his assurance that amounts invested by victims who had not received possession would be returned with 6% annual interest.
The Court ultimately directed that "the judicial officers posted at Sessions Division, Rohtak, are restrained from entertaining any bail applications in the present case."
It further observed that the status report indicated hesitation among Rohtak police officials in taking action against real estate promoters or developers. The Haryana government was expected to appoint a senior IPS officer to investigate the matter and submit a status report before the next hearing.
The Registry was directed to immediately send the order to the District and Sessions Judge, Rohtak, for strict compliance.
The matter was adjourned to October 28, 2026.
