The Punjab and Haryana High Court has granted interim regular bail to Jora Singh, a Sub-Inspector facing allegations under the Prevention of Corruption Act and the Bharatiya Nyaya Sanhita. The Court also directed the Chief Secretary, Haryana, to explain the rules and procedure governing the reinstatement of public servants facing corruption-related criminal proceedings.
The order was passed by Justice Sumeet Goel on August 27, 2026, in Jora Singh v. State of Haryana.
Background of the Case
The case arose from FIR No. 17 dated December 7, 2025, registered at the State Vigilance & Anti-Corruption Bureau, Panchkula. The FIR invoked Sections 7 and 7A of the Prevention of Corruption Act, 1988, along with Sections 61(2) and 308(2) of the Bharatiya Nyaya Sanhita, 2023.
The petitioner was arrested on April 2, 2026. According to the order, the investigation was completed and the challan was presented on May 26, 2026. The prosecution had cited 28 witnesses, but none had been examined when the bail plea was considered. The petitioner had also remained in custody for four months and 23 days and was not shown to be involved in any other FIR.
The State opposed bail, submitting that the allegations were direct and serious and that release could create a possibility of interference with prosecution evidence, particularly by intimidating the complainant.
Court’s Observation
The High Court noted that the rival claims raised issues which would have to be examined during the trial. It therefore declined to undertake a detailed assessment of those issues at the bail stage.
The Court observed,
“The rival contention raised at Bar give rise to debatable issues, which shall essentially be ratiocinated upon during the course of trial.” It further noted that there was no tangible material before it indicating that the petitioner was likely to abscond or interfere with prosecution evidence.
The Court also expressed concern about the reinstatement of public servants facing corruption-related criminal proceedings, particularly where they may return to the same department or jurisdiction connected with the prosecution. It directed the Chief Secretary, Haryana, to explain the applicable service rules and whether existing procedures require consultation with the prosecuting agency or trial court before suspension is revoked.
Decision
The High Court ordered Jora Singh’s release on interim regular bail until the next date of hearing, subject to furnishing bail and surety bonds before the concerned trial court or Duty Magistrate. The Court imposed conditions including that he must not tamper with evidence, delay the trial, misuse the bail liberty or remain absent from proceedings.
The Chief Secretary, Haryana, was also directed to file an affidavit three days before the next hearing addressing the issues concerning reinstatement.
The matter was directed to be listed on September 28, 2026, in the urgent cause list.
