The Punjab and Haryana High Court has granted regular bail to three accused in a criminal case registered at Police Station City Palwal, Haryana, involving alleged possession and supply of firearms and allegations of links with an organised criminal network.
Justice Sanjay Vashisth passed the order on August 6, 2026, allowing three connected bail petitions filed by Kuldeep Tyagi, Aman @ Aman Bhati and Akash @ Akash Bhati.
Background of the Case
The petitions were filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, which deals with the High Court's power to grant bail. The case arose from FIR No. 34 dated January 22, 2025, registered at City Palwal Police Station under provisions of the Bharatiya Nyaya Sanhita, 2023 and the Arms Act.
According to the prosecution, police acted on secret information and allegedly apprehended Akash. A country-made pistol, four live cartridges, a country-made rifle or carbine and four more live cartridges were allegedly recovered from him.
The prosecution further relied on disclosure statements which allegedly led to the involvement of Aman and other persons. The case also involved allegations concerning forged identity documents and communication through the Zangi application.
The petitioners denied having any connection with the alleged organised criminal syndicate. Their counsel argued that the investigation had already been completed, the final report had been filed and the alleged recoveries had already been made. Reliance was also placed on bail granted to certain co-accused.
State's Opposition
The State strongly opposed the bail applications. It submitted that the case was not limited to firearm recovery but was allegedly connected with an organised criminal network operating across Haryana, Delhi and Uttar Pradesh.
The State also pointed to the alleged criminal antecedents of the petitioners, stating that Kuldeep Tyagi was involved in 17 other cases, Aman in five and Akash in two other cases.
Court's Observation
After hearing both sides and examining the record, Justice Sanjay Vashisth clarified that the Court was not expressing any opinion on the merits of the prosecution case.
The bench observed that
“the investigation stands concluded and the final report has already been presented” and noted that the recoveries attributed to the petitioners had already been effected. In these circumstances, the Court held that further incarceration would serve no useful purpose.
The Court also made clear that its observations would not affect the trial, which was to be decided independently on the evidence available on record.
Decision
The High Court allowed all three petitions and ordered the release of Kuldeep Tyagi, Aman @ Aman Bhati and Akash @ Akash Bhati on regular bail, subject to furnishing bail bonds and surety bonds to the satisfaction of the concerned trial court or magistrate, provided they were not required in any other case.
The Court further directed the Additional Chief Secretary, Home Department, Haryana, to file an affidavit detailing the State's policy framework and institutional measures for dealing with organised criminal gangs and their alleged networks in Palwal, Faridabad and Gurugram.
The affidavit was directed to be filed by August 24, 2026.
