The Punjab and Haryana High Court has refused regular bail to a former Indian Army soldier accused of passing sensitive military information to Pakistani intelligence agencies. Justice Manisha Batra dismissed the bail plea on August 6, 2026, holding that the seriousness of the allegations and their bearing on national security ruled out any relief at this stage.
Background Of The Case
The petitioner, Harpal Singh alias Harbahal Singh, is an ex-serviceman who was posted with the Defence Service Corps at Air Force Station, Bikaner, after retiring from the Army. According to police, a secret informer tipped off an officer at the State Special Operation Cell in Amritsar that the petitioner was in touch with Pakistani intelligence operatives through social media. He allegedly used his old army contacts to gather confidential details about troop movements and other security-sensitive matters, and passed this information to Pakistan in exchange for money routed through hawala channels. On the day he was picked up, he was reportedly assigned to collect information on stepped-up Army activity in the Amritsar Cantonment area. He was arrested on February 7, 2026, under the Official Secrets Act and the Bharatiya Nyaya Sanhita, and the investigation has since concluded with a chargesheet filed.
Arguments In Court
Counsel for the petitioner argued that his client had served the Army for nearly seventeen years with a clean record and was not caught anywhere near a sensitive military zone — he was picked up from a wedding function, the lawyer said. It was also argued that the FIR was vague, with no clarity on what exact information was leaked or how it was transmitted, and that the ₹3,000 cited by police actually came from an acquaintance, not any handler.
The State opposed bail, telling the court that investigation had revealed the petitioner was in constant phone contact with Pakistan-based intelligence handlers, and that the case involved serious national security concerns.
Court's Observations
After hearing both sides, Justice Batra noted that the petitioner was alleged to have collected and transmitted confidential Army information relating to troop movements and military formations, in return for money. The judge observed that investigation had shown he was in constant touch with Pakistani intelligence agencies over the phone.

The court held that
"having regard to the seriousness of the allegations, the nature of the material collected during investigation and the larger public interest involved, this Court does not find it to be a fit case for extending the concession of regular bail."
The bail plea was accordingly dismissed, with the court clarifying that its observations would not affect the trial court's independent assessment of the case.
