The Rajasthan High Court has directed the State Government to appoint an Administrative Member in the Rajasthan Civil Services Appellate Tribunal, Jodhpur, by November 30, 2026, warning that senior government officials will have to appear before the Court if the deadline is missed.
A Division Bench of Justice Vinit Kumar Mathur and Justice Chandra Shekhar Sharma was hearing a civil writ petition filed by the Rajasthan High Court Advocates Association against the State of Rajasthan.
During the proceedings, the petitioner's counsel informed the Court that directions for appointing an Administrative Member had already been issued on August 5, September 9 and September 17, 2026. However, the State Government had not completed the appointment.
The petitioner submitted that service-related matters were accumulating because of the vacancy, leaving the Tribunal virtually non-functional.
Taking note of the submissions, the High Court expressed concern over the continued non-compliance with its earlier directions and issued a fresh deadline for the appointment.
The Bench directed:
"In these circumstances, the respondents are directed to appoint Administrative Member in Rajasthan Civil Services Appellate Tribunal at Jodhpur on or before 30.11.2026 failing which Chief Secretary of Rajasthan/Additional Chief Secretary, Department of Personnel (DoP) shall remain present before this Court on the next date of hearing."
The Court also clarified that the superannuation age prescribed under Rule 10 of the Consumer Protection Rules, 2020, must be followed while implementing its earlier directions concerning members and presidents of the State and District Consumer Commissions.
It further clarified that pending disciplinary or administrative proceedings against any member could continue in accordance with law and would not be protected by the Court's earlier order.
The Rajasthan High Court directed the State Government to appoint an Administrative Member in the Rajasthan Civil Services Appellate Tribunal, Jodhpur, by November 30, 2026.
The matter has been listed for further hearing on December 3, 2026.
