The Rajasthan High Court has granted bail to a 22-year-old man arrested in connection with a road incident in Hanumangarh, observing that the investigation had been completed and that continued custody was not necessary at this stage. While deciding the bail plea, the Court also took note of the conduct of the complainant, a police inspector, and directed the Director General of Police (DGP), Rajasthan, to conduct an inquiry into allegations that the officer was creating and uploading social media reels with the assistance of his son.

Background of the Case

The bail application was filed by Barbdivya S/o Swaroop Singh under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS). The case arose from FIR No. 357/2026 registered at Hanumangarh Town Police Station for offences under Sections 281 and 125(a) of the Bharatiya Nyaya Sanhita (BNS). During the investigation, Section 110 of the BNS was also added.

According to the prosecution, the complaint was lodged by Traffic Circle Inspector Anil Kumar, who alleged that an Audi car driver had performed stunts on a public road, resulting in injuries to his son, Lakshya.

The defence argued that the applicant had been falsely implicated. It further submitted that the complainant and his son regularly created reels for social media and claimed that the incident occurred when the complainant's son allegedly moved in front of the vehicle while recording content. The defence also pointed to the delay in registration of the FIR and argued that the applicant had no criminal antecedents.

Court's Observation

Justice Ashok Kumar Jain noted that the investigation had been completed and that the applicant was no longer required for custodial investigation. The Court also observed that the applicant had remained in custody for a considerable period and that the trial would take time.

Without expressing any opinion on the merits of the case, the Court found it appropriate to grant bail.

As the bench observed,

“The applicant-accused is no more required in the investigation... the Court deems it appropriate to grant bail to the applicant-accused.”

Before concluding the order, the Court expressed concern over the allegation that the complainant, a police inspector, had been preparing and uploading reels on social media platforms with the assistance of his son to build a following.

Calling the alleged conduct a matter requiring examination, the Court directed the DGP, Rajasthan, to conduct an inquiry and submit a report before the High Court within two months.

Decision

The High Court allowed the bail application and directed that Barbdivya S/o Swaroop Singh be released on bail upon furnishing a personal bond of ₹50,000 along with two sureties of the like amount, subject to conditions that he shall not tamper with evidence, influence witnesses, engage in criminal activity, and shall appear before the trial court as required.
