RG Kar Incident: CBI Rules Out Gang Rape, Probing Alleged Cover-Up, State Questions Further Investigation

The Central Bureau of Investigation (CBI) has informed the Calcutta High Court that its investigation and expert medical opinion indicate that the rape and murder of a trainee doctor at Kolkata's RG Kar Medical College and Hospital was not a case of gang rape. The agency is now focusing on the alleged cover-up following the crime.

During the hearing, the Deputy Solicitor General (DSG) representing the CBI submitted before Justice Tirthankar Ghosh that the agency was currently probing the involvement of individuals who may have attempted to conceal the incident after the crime was committed.

State's Legal Objection

Senior Counsel representing the state clarified that while the state government did not oppose the investigation into the alleged cover-up, it raised a significant legal question. The counsel argued that the trial had already concluded, and Sanjoy Roy had been sentenced to life imprisonment for his role in the crime.

"Can a trial be revived? If it cannot be revived, how can you order further investigation after the conclusion of the trial?" the state’s counsel questioned.

Court’s Directive

Following the arguments, the High Court directed the CBI to present a list of witnesses it had examined. Additionally, the court instructed the agency to produce the case diary that had been handed over by the Kolkata police when the CBI took over the investigation.

When questioned about a timeline for completing the probe, the DSG stated that it was not possible to commit to a specific timeframe, as the agency was investigating multiple aspects of the case.

Considering the situation, the court ordered the CBI to submit reports detailing the challenges it faced in continuing the investigation. These reports would help determine the obstacles in the probe and guide further proceedings.
