The Supreme Court on Friday, August 14, 2026, allowed the results of the 2026 Bar Council of Delhi (BCD) elections to be declared, but made it clear that the results will remain subject to the outcome of election disputes pending before the designated tribunals.
A Bench comprising Chief Justice of India Surya Kant and Justice Joymalya Bagchi and Justice V. Mohana said that grievances concerning the election should be examined by the Election Tribunals already constituted for such disputes.
Background of the Case
The BCD elections were held on February 21, 22 and 23, 2026, with 221 candidates contesting for 23 seats. During the counting process, allegations arose concerning manipulation of ballot papers, excess votes and other irregularities. The counting was halted after a counting staff member was allegedly found altering voter preferences on ballot papers.
The Delhi High Court later declined to order a fresh election and permitted counting to resume with safeguards. The Supreme Court had subsequently allowed counting to continue but directed that the results could not be declared without its permission.
Supreme Court's Observation
The Bench noted that election disputes relating to other State Bar Councils had already been referred to Election Tribunals headed by former judges. It found no reason to adopt a different course for the BCD elections.
The Court observed that the petitions could be disposed of with liberty to aggrieved persons to approach the Election Tribunals. It also stressed the need for an expeditious resolution of the disputes.
Preservation of Election Records
The Supreme Court directed the Bar Council of Delhi to preserve the complete election record. Delhi Police was also directed to preserve the original CCTV footage connected with the election process and provide copies to the concerned parties.
The Court requested that the pending disputes be decided expeditiously, preferably within three months.
Decision
The Supreme Court disposed of the petitions, permitting declaration of the BCD election results. However, the results will remain subject to the final outcome of the cases before the Election Tribunals.
