The Supreme Court on 11 June allowed the Brihanmumbai Municipal Corporation (BMC) to consider a revised Master Layout Plan for the Mumbai Coastal Road Garden and Promenade project, while reiterating that the proposal must remain within the limits set by the court's earlier directions.
A Bench of Justice Prashant Kumar Mishra and Justice Atul S. Chandurkar passed the order while hearing an application seeking clarification regarding the project's latest layout and concept design.
Background of the Case
The matter arose from a miscellaneous application filed in Jipnesh Narendra Jain v. State of Maharashtra & Ors. The applicant sought a clarification that the latest Master Layout and Concept Design was consistent with the Supreme Court's judgment dated January 12, 2026. The application also requested permission to finalize the detailed design and proceed with execution of the project, subject to approvals from the Municipal Corporation of Greater Mumbai.
During the hearing, counsel informed the court that after the January judgment, the project proposal was placed before the BMC's Landscaping Committee for in-principle approval.
The committee discussed the proposal in its meeting held on May 19, 2026. According to the records placed before the court, the committee noted that planning activities could move forward, but any commercial or ticketed activities would require appropriate approval before implementation.
The Bench referred to its earlier judgment, which had emphasized that the coastal road project area should remain accessible to the general public for free use.
Quoting from the January ruling, the court noted that limited regulated facilities could be introduced to maintain safety, security and public order. However, it had categorically stated that no residential or commercial development for sale or lease would be permitted on the property.
“The said area ought to be accessible for general public for its free use,” the court had observed in its earlier judgment.
The judges also took note of the Landscaping Committee's discussions, which indicated tentative support for the proposed layout. However, the project had not progressed further because of concerns regarding compliance with the Supreme Court's previous directions.
Court's Decision
After considering the submissions, the Bench directed that the revised Master Layout Plan placed at Annexure A-2 be considered by the BMC, provided it does not violate the Supreme Court's order dated January 12, 2026.
The court stated that the municipal authority should examine the layout without treating the earlier judgment as an obstacle, so long as the proposal remains within the boundaries laid down by the court.
At the same time, the Bench cautioned that the applicant must not undertake any activity contrary to the January ruling.
During the proceedings, counsel for the applicant also stated that not more than 15 percent of the project area would be used for recreational activities or ticketed access control.
With these directions, the Supreme Court disposed of the miscellaneous application and the connected plea seeking clarification.
