The Supreme Court has directed the Mumbai Metropolitan Region Development Authority (MMRDA) to deposit approximately ₹646.78 crore with the Court Registry by November 6, 2026, while hearing its appeal against a Bombay High Court judgment in favour of Reliance Industries Limited (RIL).
A Bench of Justice Dipankar Datta and Justice Sheel Nagu issued notice on MMRDA’s challenge to the High Court’s decision quashing demands exceeding ₹1,116 crore for alleged delays in completing Reliance’s convention-cum-commercial complex at Mumbai’s Bandra-Kurla Complex (BKC).
Background
The dispute arose from additional premium demands raised by MMRDA over alleged delays in completing the project. Reliance had challenged the demands before the Bombay High Court, which set aside the notices in its April 8, 2026 judgment and directed MMRDA to refund ₹646.78 crore deposited by the company.
The High Court also directed that Reliance’s bank guarantee of approximately ₹1,312 crore remain valid for 90 days.
MMRDA subsequently approached the Supreme Court, challenging the High Court’s findings and seeking relief against the refund direction.
During the hearing, Senior Advocate Abhishek Manu Singhvi, appearing for Reliance, suggested that the refund could be secured through a fresh bank guarantee.
The Bench, however, directed MMRDA to deposit the disputed amount with the Registry by the specified deadline.
“You deposit by 6th of November,” the Court said while directing compliance.
The direction concerns securing the disputed amount during the pendency of the appeal and does not finally determine the merits of MMRDA’s challenge.
The Supreme Court issued notice on MMRDA’s appeal and directed Reliance to file its counter-affidavit by October 30, 2026, with the rejoinder to follow by November 6.
The matter was directed to be listed after Diwali, with connected matters involving similar disputes also taken up for consideration.
