Supreme Court Transfers Supreme Industries and Supremo India Trademark Disputes to Ahmedabad

The Supreme Court of India has transferred two cross-commercial suits involving M/s The Supreme Industries Limited and M/s Supremo India Private Limited to the City Civil Court, Ahmedabad, to ensure that both related trademark disputes are heard by the same court. The decision was delivered on October 28, 2026, by a Bench comprising Justice S.V.N. Bhatti and Justice N.V. Anjaria.

Background

The dispute involved two commercial suits pending before different courts. M/s Supremo India Private Limited had filed Commercial Suit No. 134 of 2025 before the District Judge (Commercial), Indore, Madhya Pradesh, seeking an injunction against the use of the trademark ‘SUPREME’, removal of allegedly disputed goods from third-party e-commerce platforms, and damages of ₹15 lakh.

Separately, M/s The Supreme Industries Limited had instituted Commercial Suit No. 1294 of 2025 before the Delhi High Court. Its claims included alleged trademark and copyright infringement, passing off, destruction of disputed products, damages of ₹2,00,01,000, and recognition of ‘SUPREME’ as a well-known trademark under the Trade Marks Act, 1999.

Both companies approached the Supreme Court seeking the transfer of the other company's suit to the court where their respective proceedings had been initiated.

The Supreme Court noted that the parties were involved in related commercial disputes concerning trademark infringement and associated reliefs. Their counsel sought the transfer of the opposing party's suit to their preferred jurisdictions, but both sides agreed that the two matters should be tried before a single court.

The judgment recorded the parties' common position:

"The Counsel are at least in ad idem that both matters be tried before one Court."

Considering the competing requests and the need to place both proceedings before one forum, the Court exercised its jurisdiction and discretion to select a common venue. It clarified that it was not deciding the substantive trademark claims or expressing an opinion on the merits of the dispute.

The Court stated:

"The Transfer Petitions are ordered as indicated above."

The Supreme Court transferred Commercial Suit No. 134 of 2025 from the District Judge (Commercial), Indore, and Commercial Suit No. 1294 of 2025 from the Delhi High Court to the City Civil Court, Ahmedabad.

It directed the courts where the suits were originally instituted to transfer the respective plaints to the City Civil Court, Ahmedabad, expeditiously. Both parties were directed to appear before that court on November 26, 2026.

The transfer petitions were disposed of accordingly, and any pending applications also stood disposed of.
