The Supreme Court on Monday (20 July) stressed that the alleged misappropriation of donations collected for the Ayodhya Ram Mandir should be treated strictly as a criminal investigation and not as a political issue. While hearing a batch of petitions seeking an independent probe, the Court asked the Uttar Pradesh government to clarify whether a Special Investigation Team (SIT) could be entrusted with conducting the investigation instead of the local police.
A Bench comprising Chief Justice of India Surya Kant, Justice Joymalya Bagchi and Justice V. Mohana posted the matter for further hearing on July 27.
Background of the Case
Several petitions have been filed before the Supreme Court seeking an independent investigation into allegations of embezzlement and diversion of donations collected for the construction of the Ram Mandir in Ayodhya. The petitioners have sought reliefs including a court-monitored CBI investigation, preservation of financial and digital records, and greater transparency regarding donation receipts and accounts.
During the hearing, Solicitor General Tushar Mehta, appearing for the Uttar Pradesh government, informed the Court that an SIT had initially examined the allegations and found material indicating a cognizable offence, following which the police took over the investigation. He also submitted that a status report had been filed in compliance with the Court's earlier directions.
Court's Observations
The Bench cautioned all parties against giving the proceedings a political colour.
"Just a word of caution... Don't politicise the issue. Courts are not a place for politics. It's a simple case of commission of crime. We are just to ensure proper investigation," the Bench observed.
The Court also sought clarification on whether the earlier SIT, which included senior officials, could itself be assigned the investigation to ensure fairness and public confidence.
When concerns were raised about preservation of donation records and digital evidence, the State assured the Court that all relevant records had been secured.
Court's Decision
The Supreme Court directed the Uttar Pradesh government to obtain instructions on the feasibility of constituting or assigning an SIT to investigate the allegations.
It adjourned the matter to July 27, stating that it would consider the investigation mechanism and issue appropriate directions after hearing the parties.
