M/s Swagat, a famous restaurant chain in the capital city of Delhi, has approached the Delhi High Court alleging trademark infringement by Telangana-based hotel chain, Hotel Swagat. The main dispute is over the use of the name 'Swagat', to which both the businesses claim rights.
The matter came up before Justice Amit Bansal, who issued notices in both the main suit and the interim injunction application. Also, the court issued notice on the correction petition filed by the Delhi-based restaurant seeking cancellation of the rival hotel's trademark registration.

"The court has directed the respondent-hotel to file its written statement and reply to the application for interim relief within 30 days," the bench said.
The plaintiff, M/s Swagat, operates hotels and restaurants on a franchise model in New Delhi and adjoining areas and has alleged that the use of the name 'Swagat' by this Telangana-based entity causes confusion among consumers and harms its brand reputation.
On the other hand, the defendant, Hotel Swagat, claimed that it has been operating in Telangana since 1991 and is currently running 11 hotels under the same name. It also told the court that it had previously operated a hotel in Dubai under the name Swagat for three years.
"The court also issued notice on the curative petition and granted six weeks' time to the respondents to file their reply," the order said.

The court has fixed both the matters for further hearing on August 27, 2025.
