(1) Where any tree is fallen or destroyed by wind, fire, lightening or torrential
rain, the Tree Officer may, suo motu or on information given to him, after holding such
inquiry as he deems fit and giving a reasonable opportunity to the owner or occupier
of the land where the tree existed, by order, require such owner or occupier 1[to plant
one or more trees of the local species] in place of the tree so fallen or destroyed of
the same or 2[other local species] at the same or other suitable place as may be specified
in the order.
(2) Where an order is made under sub-section (1), the owner or occupier of the land shall comply with the order within ninety days from the receipt thereof.
