(1) The rent of a tenant shall not be enhanced by more than one-fourth of his existing rent, subject to the condition that the rent fixed shall in no case be less than three quarters of the rent calculated at the appropriate sanctioned rates.
(2) This section shall not apply to a decree or order of a Court for enhancement of rent on account of an increase in area.
(3) In decreeing an enhancement of rent, if the enhancement is not less than onefourth of the existing rent, and if the Court considers that the immediate enforcement of the decree to its full extent will be attended with hardship to the tenant, the Court may direct that the enhancement shall take effect by yearly increments extending over any number of years not exceeding three.
