(1) Every
Municipality shall prescribe a line on either side or both sides of a
public street within the Municipality and may from time to time
prescribe a fresh line in substitution of any line so prescribed or of
any part thereof if the Municipality thinks the prescribing of such
fresh line to be necessary for the purpose of widening such public
street or any part thereof :
Provided that-
(a) atleast one month previous to prescribing such line or
fresh line, as the case may be, the Municipality shall
put up special notice of the same in the street or part
of the street for which such line or fresh line is
proposed to be prescribed and shall also give notice
thereof to the owners for occupiers of the land
affected by such alignment;
(b) the Municipality shall consider any written objection
or suggestion in regard to such proposal delivered at
the office of the Municipality within such time as
may be specified in such special notice; and
(c) the Municipality shall cause to be prepared, a map of
the area comprised within the said line and the street
concerned and a statement specifying the lands
enclosed therein, which shall be open for the
inspection of the public(2) The line for the time being so prescribed shall be called
the regular line of the public street.
(3) No person shall construct or re-construct any portion of
any building within the regular line of the public street.
(4) If any person contravenes the provisions of sub-section
(3), he shall be punishable on conviction with fine which shall not
be less than two thousand rupees but which may extend to five
thousand rupees and the Municipality shall&
(a) direct that such construction or re-construction
be stopped; and
(b) by a written notice, require the building or any
portion thereof so constructed or re-constructed
to be demolished.
(5) Any person aggrieved by an order of the Municipality
under sub-section (4) may within thirty days from the date of such
order, exclusive of the time requisite for obtaining a copy thereof,
appeal to the Collector and the order of the appellate authority shall be
final and shall not be liable to be called in question in any court.
