(1) Except as otherwise provided by the terms of his theka a thekedar, may exercise, during the period and to the extent of his theka, all the rights of the lessor under this Act, except, -
(a) the right to sue for enhancement of rent;
(b) the right to sue a rent-free grantee or grantee, holding at a favourable rate of rent under the provisions of Chapter IX.
(2) The rights mentioned in clauses (a) and (b) of sub-section (1) may be exercised by the thekedar only if they are conferred expressly by the terms of the theka.
(3) Rights which may be exercised by a thekedar under the foregoing sub-sections shall not be exercised by the lessor during the period of the theka.
(a) the right to sue for enhancement of rent;
(b) the right to sue a rent-free grantee or grantee, holding at a favourable rate of rent under the provisions of Chapter IX.
(2) The rights mentioned in clauses (a) and (b) of sub-section (1) may be exercised by the thekedar only if they are conferred expressly by the terms of the theka.
(3) Rights which may be exercised by a thekedar under the foregoing sub-sections shall not be exercised by the lessor during the period of the theka.
