Section 219

Buildings, Railways and Private Streets Not to Be Erected Or Constructed Over Water-mains Or on Municipal Drains Without Permission.-

(1) Without the permission of the Chief Municipal Officer, no building, wall, fence or other structure shall be erected, and no railway or private street shall be constructed, on any municipal drain constructed or maintained by, or vested in, the Municipality. (2) If any building, wall, fence or other structure is erected, or any railway or private street is constructed, on any drain or waterworks without the permission as aforesaid, the Chief Municipal Officer may remove, or otherwise deal with, such erection or construction in such manner as he may think fit. (3) The expenses incurred by the Chief Municipal Officer for carrying out the purposes of sub-section (2) shall be paid by the owner of the private street or of the building, fence, wall or other structure or, as the case may be, by the railway administration or the person responsible, and shall be recoverable as an arrear of tax under this Act
