(1) In
every building owned or occupied by the Government or a
statutory body or a company or an institution owned or controlled
by the Government, rain water harvesting structure shall be
provided by the Government or by such statutory body or company
or institution, as the case may be, in such manner and within such
time as may be prescribed.
(2) Every owner or occupier of a building other than that
referred to in sub-section (1) shall provide rain water harvesting
structure in the building in such manner and within such period
as may be prescribed in the bye-laws or otherwise.
Explanation.- Where a building is owned or occupied by
more than one person, every such person shall be liable under this
sub-section.
(3) Without prejudice to any action that may be taken under
the provisions of this Act, where the owner or occupier of the
building fails to provide the rain water harvesting structure in the
building within the period prescribed under sub-section (2), he shall,
on conviction, be punished with fine which shall not be less than
rupees ten thousand but which may extend to rupees twenty thousand.
(4) No water connection from any public water supply
system shall be permitted in newly constructed building unless the
owner or occupier thereof produces a certificate from the
concerned Municipality to the effect that rain water harvesting
structure has been provided in the building.
