Section 96

Power to Make Rules

(1)- The State Government may, by notification in the Gazette, matkg rules for carrying out the purposes of this Act.
(2)- In particular, and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely -
(a)- the powers of the auditor under sub-section (3) of Section 50;
(b)- the procedure in respect of surcharge under Section 51 including the provision of appeal, if any, in respect thereof;
(c) -the procedure that may be followed by a Jal Sansthan or any other agency for assessment of the annual value under sub-section (3) of Section 53 including the authentication and custody of assessment lists, the revision and duration of such lists, the amendment and alteration of such lists, and appeals in case of dispute in respect of assessment;
(d) -any other matter which is to be or may be prescribed.
(3)- All rules made under this Act shall, as soon as may be after they are made, be laid before each house of the State Legislature, while it is in session for a total period of not less than thirty days, comprised in its one session or more than one successive sessions, and shall, unless sortie later date is appointed, take effect from the date of their publication in the Gazette subject to such modifications or annulments as the two Houses of the Legislature may, during the said period, agree to make, so, however, that any such modification or annulment shall be without prejudice to the validity of anything previously done thereunder.
