(1)
The State Government may, by notification in the Official Gazette, constitute one or more Industrial Tribunals for the adjudication of industrial disputes relating to any matter whether specified in the First Schedule or the Second Schedule.(2)
A Tribunal shall, except where otherwise provided under Section 5-A, consist of one person only to be appointed by the State Government.(3)
A person shall not be qualified for appointed as the Presiding Officer of a Tribunal unless, -(a)
he is or has been a Judge of a High Court; or](b)
he has held the Office of the Chairman or any other member of the Labour Appellate Tribunal constituted under the Industrial Disputes (Appellate Tribunal) Act, 1950, for a period of not less than two years or of any Tribunal constituted under the Uttar Pradesh Industrial Disputes Act, 1947, for a period of not less than five years; or(c)
he is enrolled in the list prepared in accordance with Section 4-D.(4)
The State Government may, if it so thinks fit, appoint up to two persons as assessors to advice the Tribunal in the proceedings before it.Previous
