Section 33: Cognizance of offence
Cognizance of offence.
(1)
No prosecution for an offence punishable under this Act shall be instituted except on a complaint authorised by the District Magistrate :Provided that where the District Magistrate has improperly or illegally declined to authorise the making of a complaint, the Commissioner may, of his own motion or on application made in this behalf, direct him so to do.(2)
No court inferior to that of a magistrate of the first class shall try any such offence.Previous
