Section 130: Removal from office
Removal from office.
(1)
The Board may with the approval of the Authority remove from office any member including the Sarpanch or Upa-Sarpanch, who has been guilty of misconduct or neglect of, or incapacity to perform his duty, or is persistently remiss in the discharge thereof:Provided that, no such person shall be removed from office, unless the Chairman or any other officer of the Board authorised by him in this behalf holds an enquiry after giving due notice to the Panchayat and the person concerned; and the person concerned has been given a reasonable opportunity of being heard and thereafter, the Chairman or the said officer, as the case may be, submits his report to the Board.(2)
Where a person is removed from office of the Sarpanch, Upa-Sarpanch or member, he shall not be eligible for renomination as Sarpanch, Upa-Sarpanch or member, during the remainder of the term of the office of members of the Panchayat.Disclaimer: This section is reproduced for general informational and reference purposes only.
