The Supreme Court on Tuesday (4 August) deferred the hearing on Asaram's request for interim medical bail after examining a fresh medical assessment prepared by the All India Institute of Medical Sciences (AIIMS). The report concluded that he does not require admission to a hospital, although it recommended continuous care from trained medical attendants. The matter will now be heard on August 6.
A Bench of Justice MM Sundresh and Justice PB Varale considered the report during the proceedings but did not pass any order on the bail request.
"The first part of the report says hospitalisation is not required. Then it says round-the-clock medical attention. We will keep it for hearing day after," the Bench remarked while fixing the next date of hearing.
Background of the Case
The proceedings arise from Asaram's appeal before the Supreme Court challenging a Rajasthan High Court judgment that affirmed his conviction in a 2013 criminal case. Along with the appeal, he has filed an application seeking interim medical bail, contending that his health condition requires special treatment.
During an earlier hearing, the Supreme Court directed AIIMS to conduct an independent medical examination after deciding that an expert assessment was necessary before considering the plea.
Court Observation
The AIIMS medical board informed the Court that hospitalisation was not medically necessary at present. At the same time, the report stated that Asaram should remain under the supervision of trained caregivers throughout the day because of multiple age-related and chronic health conditions.
After reading the report, the Bench noted that while it ruled out hospital admission, it also referred to the need for continuous medical assistance. The judges said the issue would require further consideration after hearing all sides.
Decision
The Supreme Court did not decide the request for interim medical bail at this stage. Instead, it directed that the matter be listed again on August 6, when the Court will continue hearing the application after considering the AIIMS report and the submissions of the parties.
