Allahabad High Court Directs Police to Ensure Lawyers’ Unhindered Access During Maha Kumbh, Stresses Justice Cannot Wait

The Allahabad High Court has taken a firm stance on ensuring the smooth functioning of judicial processes, even during large-scale public events like the Maha Kumbh. In a recent order, the court highlighted the responsibility of police and civil administrations to prioritize lawyers’ unhindered access to courts, stressing that justice delivery must not be compromised.

Case Background 

The case in question, Harkhu And 2 Others vs. State Of U.P. And 8 Others (WRIT - B No. 29 of 2025), was adjourned twice due to lawyers’ inability to reach the court on time. Severe traffic congestion in Prayagraj, caused by the influx of devotees during the Maha Kumbh, delayed counsel from attending hearings scheduled for 10 AM. Justice J.J. Munir noted that while the court acknowledges the exceptional circumstances, such logistical challenges should not disrupt judicial proceedings.

In a strongly worded order dated February 6, 2025, the bench emphasized:

“It is the duty of the Police to ensure that movement of learned counsel to the Court is unhindered… Any hindrance during Court hours impedes the dispensation of justice.”

The court underscored that the High Court’s operations cannot be paralyzed by external contingencies. It directed the Police Commissioner of Prayagraj and the Traffic Police to implement special measures guaranteeing lawyers’ timely access. The order was swiftly communicated to the Commissioner via the Chief Judicial Magistrate, Allahabad, through the Registrar (Compliance).

Justice Munir reiterated that administrative authorities must prioritize the judiciary’s needs, especially during large gatherings. The court warned that failing to address such issues could lead to systemic delays, eroding public trust in legal institutions.

With the case adjourned for a third time to February 18, 2025, the court made it clear that further delays due to traffic mismanagement would be unacceptable. This decision reflects the judiciary’s commitment to balancing respect for cultural events with upholding its constitutional mandate.
