The Andhra Pradesh High Court at Amaravati has turned down a woman's plea to revive her husband's conviction in a dowry harassment case. Justice Subhendu Samanta, hearing the matter on July 21, 2026, found the lower appellate court's reasoning sound and declined to disturb the acquittal that had already been granted.
Background of the Case
The dispute traces back to a complaint filed by the wife against her husband and his sister, accusing them of mental cruelty and dowry demands - offences under Section 498-A of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act, 1961. In 2006, the trial court, the V Additional Munsif Magistrate, Guntur, convicted the husband but let his sister off, acquitting her of all charges.
The husband took the conviction in appeal before the III Additional Sessions Judge, Guntur. In December 2007, the Sessions Court set aside his conviction, reasoning that since the allegations against both accused rested on the very same evidence, it made little sense to convict the husband once his sister had already been cleared on identical facts. Unwilling to let the matter rest, the wife moved the High Court in revision, also seeking condonation of a 190-day delay in filing her plea.
Court's Observations
Going through the record, Justice Samanta backed the Sessions Court's view. The bench observed that the case against the husband and his sister was inseparable, built on common evidence with nothing to distinguish one accused's role from the other's.
As the order put it, once the evidence had already failed to hold up against the sister, there was "no legal basis to sustain the conviction" of the husband on the same facts. The Court also remarked that the appellate findings "disclose proper appreciation of the evidence," leaving little room to fault the reasoning below.
The Decision
Finding no illegality or impropriety in the Sessions Court's order, the High Court held the revision case devoid of merit and dismissed it.
All miscellaneous petitions pending in the matter, including the delay condonation plea, were closed along with it.
