The Delhi High Court has allowed Gujarat-based NGO Justice on Trial to withdraw its defamation suit against the British Broadcasting Corporation (BBC) concerning the documentary India: The Modi Question. The order was passed by Justice Tushar Rao Gedela on September 3, 2026.

Appearing for the NGO, Advocate Siddharth Sharma submitted that notice had been issued only on the Indigent Person Application (IPA), not on the suit. He told the Court that instructions had been received to withdraw both the application and the suit, with liberty to file a fresh case on the same cause of action.

"Accordingly, the I.P.A. 1/2023 alongwith the suit is dismissed as withdrawn with liberty so sought, granted."

Justice Tushar Rao Gedela accordingly dismissed Justice on Trial v. British Broadcasting Corporation (India) & Anr. as withdrawn, while granting liberty to institute a fresh suit on the same cause of action.
